Terms of Service

These Terms of Service ("Terms") govern your use of the Hydrate iOS app and the website at hydrateai.app (together, the "Service"), operated by Hydrate ("we", "us", or "our"). Please read these Terms carefully before using the Service.

By downloading the app, visiting the website, or using any part of the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Acceptance of Terms

By using the Service you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

We reserve the right to update these Terms at any time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

2. Description of Service

Hydrate is a personal hydration tracking application available on iOS. The Service helps you log water intake, set personalised hydration goals, track streaks and progress, and receive AI-generated coaching messages. The website at hydrateai.app provides information about the app, a hydration calculator, and related content.

The Service is intended for personal wellness motivation. It is not a medical device, does not provide medical advice, and should not be used as a substitute for professional healthcare. See Section 8 for our full AI coaching disclaimer.

3. Eligibility

You must be at least 13 years old (or the applicable minimum age in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this requirement. If you are under the age of majority in your jurisdiction, you confirm that you have obtained the consent of a parent or guardian.

We do not knowingly permit children under 13 to use the Service. If we become aware that a user is under 13, we will take steps to remove their data promptly.

4. User Account & Data

Hydrate does not require you to create an account or provide an email address. Your profile and data are stored locally on your device and optionally synced to your private iCloud account. You are responsible for maintaining the security of your device and iCloud account.

You are responsible for the accuracy of the information you enter (such as your name, weight, and health considerations). Providing false or misleading information may affect the quality of the personalised recommendations you receive.

You may delete your data at any time from the Settings screen within the app. Uninstalling the app removes all locally stored data from your device.

5. Premium Subscriptions

Hydrate offers a premium subscription that unlocks additional features, including but not limited to: custom themes, cycle-aware hydration goals, mood and energy logging, AI daily recap, AI smart reminders, additional widget sizes, and Siri Shortcuts.

Billing & Renewals

All in-app purchases and subscriptions are processed by Apple through the App Store. By purchasing a subscription, you agree to Apple's payment terms and the subscription pricing displayed at the time of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.

Cancellation

You can manage or cancel your subscription at any time through your Apple ID settings (iOS Settings › Apple ID › Subscriptions). Cancelling stops future renewals; you retain access to premium features until the end of the current billing period.

Refunds

All refund requests must be directed to Apple. We do not process refunds directly. To request a refund, visit reportaproblem.apple.com or contact Apple Support.

Free Tier

Core hydration tracking features — including water logging, daily goal, streaks, and the Sassy AI coaching mode — are available at no cost. We reserve the right to adjust which features are included in the free tier at any time, with reasonable notice.

6. Acceptable Use

When using the Service, you agree not to:

  • Reverse engineer, decompile, or attempt to extract the source code of the app
  • Circumvent or attempt to bypass premium feature gates or subscription verification
  • Scrape, crawl, or use automated tools to access the website or API endpoints
  • Upload, transmit, or store content through Glow Journey photos that is unlawful, harmful, or offensive
  • Use the Service in any way that violates applicable local, national, or international law or regulation
  • Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure

Violation of these terms may result in suspension or termination of your access to the Service.

7. Social Features

Hydrate includes optional social features: the Weekly Leaderboard and Bestie Challenges. Both are entirely opt-in. By participating, you agree to the following:

  • Your first name and hydration score will be visible to other participants
  • You are responsible for the name you choose to display publicly
  • Leaderboard records are retained for the duration of the relevant week; Bestie Challenge records for the duration of the challenge
  • We reserve the right to remove any leaderboard or challenge record at our discretion

You can opt out of the leaderboard at any time in Settings. Your public record will be removed promptly.

8. AI Coaching Disclaimer

The AI-generated coaching messages, daily recaps, and hydration goal calculations provided by Hydrate are for motivational and informational purposes only. They do not constitute medical advice, diagnosis, or treatment.

Always consult a qualified healthcare professional before making changes to your diet, exercise routine, or fluid intake — especially if you have a medical condition, are pregnant, are breastfeeding, or are taking medication. Do not disregard professional medical advice or delay seeking it because of anything you read or receive within the Service.

AI-generated content may occasionally be inaccurate, incomplete, or inappropriate. We do not guarantee the accuracy of any AI output and are not liable for any actions you take based on AI coaching messages.

9. Intellectual Property

The Hydrate app, website, branding, content, graphics, and underlying code are owned by or licensed to Hydrate and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our express written permission.

Your personal content — including hydration logs, Glow Journey photos, and mood entries — remains yours. By using features that involve shared data (such as the leaderboard), you grant us a limited, non-exclusive, royalty-free licence to store and display that data solely for the purpose of operating those features.

10. Third-Party Services

The Service integrates with third-party platforms. Your use of those integrations is also governed by the respective third party's terms and policies:

  • Apple HealthKit — subject to Apple's HealthKit terms and your iOS Health settings
  • Apple CloudKit & iCloud — subject to Apple's iCloud terms and your Apple ID agreement
  • OpenRouter / Google Gemini AI — subject to OpenRouter's and Google's respective terms of service
  • Siri Shortcuts — subject to Apple's terms for Siri and App Intents
  • App Store — subject to Apple's Media Services Terms and Conditions

We are not responsible for the availability, accuracy, or practices of any third-party service. Links to external websites from hydrateai.app are provided for convenience only and do not imply endorsement.

11. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components; that AI coaching messages will be accurate or complete; or that hydration goals calculated by the app are appropriate for your individual health needs.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Hydrate and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, loss of profits, or personal injury — arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us (if any) in the twelve months preceding the claim. If you have not paid us anything, our total liability shall be limited to $1.00 USD.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.

13. Changes to These Terms

We may update these Terms from time to time to reflect changes in the Service, applicable law, or our practices. When we do, we will update the "Last updated" date at the top of this page. For significant changes, we will provide notice via an in-app message or by posting a notice on hydrateai.app.

Your continued use of the Service after updated Terms are posted constitutes your acceptance of the changes. If you do not agree to the revised Terms, please stop using the Service and uninstall the app.
